In order to receive exemplary damages, the plaintiff must show the defendant acted with malice by intentionally causing the injury, or because the defendant knew his conduct created an extreme risk of severe injury and consciously disregarded that risk.
- Compensatory Damages – Compensatory damages include both economic and non-economic damages, but not any form of exemplary or punitive damages.
